3. Platform Use & Accounts

When you access our client portal, dashboard, or automation system:

You are responsible for maintaining the confidentiality of your login credentials.

You agree to use the system for lawful business purposes only.

You must not share access with unauthorized parties.

We may suspend or terminate access if misuse, abuse, or fraudulent activity is detected.

Access to the platform does not grant ownership of the software or underlying intellectual property.

4. Payments, Billing & Refunds

Depending on your selected plan, you may be charged a one-time setup fee and/or a recurring subscription fee.
All payments are processed securely via our integrated billing provider.

Setup Fees are non-refundable once work has begun.

Monthly Subscriptions renew automatically unless canceled in writing at least 7 days before the renewal date.

Performance Guarantees: Any “Lead Guarantee” or “Money-Back Offer” is subject to the specific terms defined in your signed service agreement or onboarding form.

Late or failed payments may result in suspension of access to services.

The AI Contractor Playbook and other free downloads are provided for educational purposes only.
Accessing these materials does not establish a client-agency relationship.
Results and examples shared are based on real-world data but do not guarantee identical outcomes.

6. Marketing Automations, Calls, & Messaging

Our AI and automation systems may send communications (SMS, emails, calls) on your behalf as part of your marketing workflows.
You are responsible for ensuring that your business complies with:

CAN-SPAM Act

GDPR or equivalent privacy laws

You acknowledge that Build Pro Marketing acts as a service provider facilitating communications via third-party APIs.

7. Data Collection & Privacy

We collect limited business and personal information to deliver our services.

All data is stored securely within our CRM and third-party partners (including GoHighLevel).
We do not sell, trade, or rent client data.

We are not liable for downtime, performance issues, or damages caused by these third-party services.

All materials, websites, funnels, templates, and designs created by Build Pro Marketing remain our intellectual property unless otherwise agreed in writing.

You may not reproduce, distribute, or resell our proprietary systems, templates, or brand assets without written permission.

10. Limitation of Liability

To the maximum extent permitted by law, Build Pro Marketing shall not be liable for:

Any indirect, incidental, or consequential damages

Loss of profits, data, or goodwill

Results or performance not achieved due to user error, ad performance, or market changes

Total liability shall not exceed the amount paid for the service within the last 30 days.
